Standard Terms of Business
Supply of Spectacles
The terms of business and contracts entered into between Robert Frith Optometrists* and the patient are set out below and are the basis of all transactions unless otherwise specifically agreed before the placement of order and/or payment.
VAT Partial Exemption
The total cost to you of the provision and dispensing of your spectacles** or corrective lenses by Robert Frith Optometrists is a combination of:
A contract and charge for professional fees and services
A contract and charge for goods.
The total cost is made up as follows:
Cost of spectacles (goods) at 35% of the total cost, including VAT.
Professional fees (services) at 65% of the total cost of the spectacles.
VAT is payable on the goods at the rate of 20%. The Professional Fee’s are exempt from VAT and therefore attract no VAT. The split of 35/65% is an ration agreed with HMRC (HM Revenue & Customs) and does not necessarily reflect the actual breakdown of VATable/exempt fees for a particular individual pair of spectacles.

A minimum deposit of 50% is required before ordering.
Balance of payment must be made on collection of goods.
Collection must be made within thirty days of order completion notification.
Whilst in the interest of transparency we show prices of professional fees and product costs separately we are primarily providers of clinical and professional services and have a duty of care to our patients unlike normal retailers thus we are unable to supply frames or lenses without the attendant professional charges.
Special Offers
From time to time Robert Frith Optometrists* may offer various discounts and special offers and the following points should be noted.
Unless specifically stated no two offers may be used in conjunction.
Discounts will be given against the cost of spectacles (goods) not our professional fees (services).
* - Robert Frith Optometrists is the trading name of all companies within the alliance of practices
** - The term “spectacles” refers to a complete pair of frames and lenses

10 Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

A person who is not a party to these terms and conditions has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.
12 Governing Law
These terms and conditions are governed by and will be interpreted in accordance with English law and the English courts will have exclusive jurisdiction to resolve any disputes between us.
Thank you for considering purchasing your contact lenses from us. In order to supply lenses via the Internet there are certain rules and regulations to which we have, by law, to conform. These are designed to protect you and your eyes.
By using the Site you agree to be bound by the terms set forth herein. We may make changes to the Site, these Terms and Conditions of Use, or the policies and conditions that govern the use of the Site at any time. We encourage you to review the Site and these terms periodically for any updates or changes. Your continued access or use of the Site shall be deemed to be your acceptance of these changes and of the reasonableness of these standards for notice of changes. This contract is personal to you and may not be transferred to any other person.
VALID PRESCRIPTION REQUIRED
Before we can supply lenses we need a copy of your contact lens specification, which will have been given to you by your optician. You are entitled to this document by law and it will contain your lens specification, the optician who prescribed them and the date of expiration. We only need this once during the lifespan of the specification and you will be able to order lenses freely one this is registered with us.
You hereby certify that you have a valid prescription for the contact lenses that you are ordering. You represent and warrant to Robert Frith Services Ltd by placing an order that information you enter into the Site is valid and true and matches exactly your prescription as provided by your eyecare provider. You further certify that your prescription is under 1 years old (unless otherwise specified on a valid prescription) and that you are neither blind or partially sighted and are over 16 years of age. You hereby consent to our contacting your eyecare provider, if necessary, to verify your prescription information and any other necessary information.
Should you not have an up to date specification meaning we are unable to supply your lenses we will naturally be pleased to refund the full cost of the transaction.
Cooling-off Period
By law, customers in the European Union also have the right to withdraw from the purchase of an item within seven working days of the day after the date the item is delivered
By placing an order you are giving us permission to contact your optician to confirm your specification according to the duty of care imposed on us by the opticians act.
The Law regarding the Internet supply of contact lenses
The Opticians Act states that contact lenses can only be supplied on-line under supervision of a registered optometrist, dispensing optician or contact lens optician. When ordering lenses the supplier (Robert Frith Services) must have sight of the original specification document issued by the fitting optician, or a copy of the said document, this can be a facimile or scanned copy. In the case where a copy is supplied the supplier (Robert Frith Services) must, by law, contact the prescribing optician and verify that the details o the specification are correct. This need only be done once during the lifespan of the specification. When the specification expires you will need to have a further contact lens aftercare and forward us the specification.
